These Terms of Service ("Terms") govern your access to and use of MEDIA EMPIRE, a fictional-world broadcasting-station management simulation game (the "Service"), operated by the MEDIA EMPIRE Project Team ("we," "us," "the Team").
1. Acceptance of Terms
By accessing or using MEDIA EMPIRE, whether the current web version or the planned Windows/Unity version, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Description of Service
MEDIA EMPIRE is a single-player simulation game in which you manage a broadcasting station in an entirely fictional world. All companies, people, programs, advertisers, ratings, and in-game events are fictional and created for gameplay purposes. Any resemblance to real companies, individuals, or events is purely coincidental. The game does not use, license, or reference any real-world brands, trademarks, or intellectual property.
3. Eligibility and Age Requirements
The Service is intended for general audiences. If local law sets a minimum age for using online services without parental consent, you confirm that you meet that age or have your parent's or guardian's permission to use the Service.
4. License to Use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use MEDIA EMPIRE for your own non-commercial entertainment. You may not sublicense, sell, rent, or otherwise commercially exploit the Service or your access to it.
5. User Conduct
When using MEDIA EMPIRE, you agree not to:
- Cheat, exploit bugs, or abuse game mechanics in ways that harm the Service or other users;
- Attempt to reverse-engineer, decompile, or disassemble the game client or backend in order to attack, disrupt, or gain unauthorized access to the Service;
- Scrape, flood, or otherwise access our API beyond fair, ordinary gameplay use;
- Submit or use illegal, infringing, hateful, or otherwise unlawful content anywhere the game lets you enter text, including station or program titles.
We may investigate and take action, including suspending access, against conduct that violates this section.
6. User-Provided Content
Certain features let you type free-text content, such as station names, program titles, or character names ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, royalty-free license to store, display, process, and transmit it (including to OpenAI, where you use AI features) solely to operate and improve the Service. You are solely responsible for the User Content you submit and confirm it does not violate Section 5.
7. Intellectual Property
The MEDIA EMPIRE game, including its software, source code, game design, simulation data, artwork, and branding, is owned by the MEDIA EMPIRE Project Team or its licensors and is protected by copyright and other intellectual property laws. The game incorporates open-source software components, each governed by its own license; nothing here restricts rights granted under those licenses. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
8. AI-Generated Content Disclaimer
Optional features may use the OpenAI API to generate program-concept suggestions or balance-analysis reports. This content is generated automatically and may be inaccurate, nonsensical, or unsuitable for your goals. AI-generated output is provided for entertainment and inspiration only, does not constitute professional, financial, legal, or business advice, and should not be relied upon as fact.
9. Service Availability, Beta Status, and Changes
MEDIA EMPIRE is provided on an evolving basis and portions of the Service may be in beta, experimental, or pre-release status. We may modify, suspend, or discontinue any feature, or the Service as a whole, at any time, with or without notice, and we do not guarantee uninterrupted or error-free operation. The planned Windows/Unity version is not guaranteed to launch on any particular timeline.
10. Saved Game Data
We make reasonable efforts to preserve your saved games, but saves may be lost due to technical failure, maintenance, service discontinuation, deletion after prolonged inactivity, or other causes. We do not guarantee the permanence, availability, or recoverability of saved games and recommend you not treat in-game progress as irreplaceable.
11. Fees
MEDIA EMPIRE is currently free to use. We may introduce optional paid features in the future; if we do, their pricing and scope will be clearly announced before they take effect, and existing free functionality will not be retroactively locked behind a paywall without notice.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the MEDIA EMPIRE Project Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, saved games, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Indemnification
You agree to indemnify and hold harmless the MEDIA EMPIRE Project Team from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.
15. Termination
We may suspend or terminate your access to the Service, in whole or in part, at any time, for conduct that violates these Terms or for operational reasons. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 7, 8, 12, 13, 14, and 16) will survive.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the Seoul Central District Court, except where mandatory consumer-protection laws of your country of residence entitle you to bring a claim in your local courts or provide protections that cannot be waived by contract, in which case those mandatory provisions will continue to apply.
17. Severability
If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Changes to These Terms
We may revise these Terms from time to time. Material changes will be reflected by a new version number and effective date at the top of this document. Continued use of MEDIA EMPIRE after a revision takes effect constitutes acceptance of the revised Terms.
